SenoRx Successfully Settles Lawsuit

ALISO VIEJO, Calif.--(HSMN NewsFeed)--May 25, 2006--SenoRx, Inc. today announced that it has reached a settlement agreement with Suros Surgical Systems related to a suit that Suros filed in the U.S. District Court for the Southern District of Indiana in February 2005. The suit filed by Suros alleged patent infringement by SenoRx of Suros' U.S. Patent No. 5,997,560.

The litigation was resolved without admission of liability by either party and without any payments by either party. Under terms of the settlement, SenoRx agreed to remove the transverse slot from the cutter of its EnCor(TM) breast biopsy device.

Suros may reinstitute the litigation if SenoRx sells EnCor(TM) cutters with a transverse slot after October 31, 2006.

"We are pleased to have resolved this litigation without any interruption in supply of our enCor System to our customers. We have already been manufacturing and selling the modified enCor cutter in commercial quantities throughout 2006 and we do not believe the modification has any impact on the enCor device," stated Lloyd H. Malchow, President and CEO.
